A Quick Overview – How We Work
Our goal is to make your website project clear, structured, and stress-free — with no surprises for either side.
We begin by agreeing on the right level of planning, so your site is properly scoped before any development starts. Website design and build work is delivered in stages, with clear review points and milestone payments.
During development, your site is built in a private environment for testing and feedback, and full access is handed over only once the project is complete and paid for. If anything changes along the way, we discuss it first and adjust the scope or costs transparently.
These terms exist to protect your investment, ensure quality outcomes, and keep the process fair, professional, and predictable from start to finish.
Website Design & Development
Please note the following terms and conditions are current as of 01/01/2026. Our pricing and offerings are reviewed annually and any changes in prices and offerings take effect from the following month. All clients are required to confirm they have read & accept our terms in full before commencing any work.
Planning & Discovery Phase
Website planning and discovery may be provided as a standalone, chargeable service prior to website design and development. This phase may include clarification of project objectives, site structure, content requirements, functionality planning, budgeting guidance, and preparation of a detailed proposal and scope of work.
Planning fees are quoted separately, paid in advance, and are non-refundable. Completion of the planning phase does not obligate either party to proceed with website development.
Any proposal or quotation produced as a result of the planning phase is based on the information available at that time and is valid for a limited period as stated. Material changes to project requirements may require re-planning or re-quotation.
Project Scope
Hue Marketing provides quotations based on our best understanding of the project scope and requirements collected through the website briefing document and discussions to date. If there are any inaccuracies, the client must notify Hue Marketing prior to approval so adjustments can be made. Once a quotation is approved, any changes or additions outside the agreed scope may incur additional costs.
Project Timings
Quotations are valid for 30 days and assume the project will commence within 30 days of agreement. Hue Marketing reserves the right to re-quote if the project does not commence within this timeframe.
Proposed timelines are estimates and may be adjusted where delays occur outside Hue Marketing’s control, including delays in supplying content, feedback, or approvals. Where a project becomes dormant or significantly delayed, Hue Marketing reserves the right to re-quote if required.
Website Design Process
Hue Marketing follows a defined website design and development process for all website packages. Further details can be provided upon request. More detailed information can be found here.
Website Design & Development
Hue Marketing is responsible for the design and development of the website as defined by the approved scope. All design and development work is completed in-house and informed by current industry best practices, with a strong focus on responsive design, usability, performance, and long-term maintainability across modern devices and browsers.
The website is developed on a live but private staging environment and presented via a secure link for client review, testing, and approval. This environment is not publicly accessible and is intended solely for development and quality assurance prior to launch.
Website Hosting During Development
Unless otherwise agreed in writing, all websites are developed on a private development or staging environment provided or arranged by Hue Marketing. This environment is used exclusively for development, testing, and review and must not be used for live business operations.
Where clients intend to control their own hosting long-term, hosting may be temporarily arranged as part of the development process and transferred upon project completion and receipt of final payment.
Client hosting credentials are not required or used during development and are only implemented once the website is approved, paid for in full, and ready for launch.
Website Access & Control
During planning and development, client access is provided for review and feedback purposes only and does not include full administrative control unless explicitly agreed in writing.
Full administrative access, hosting credentials, and ownership control are provided only after receipt of final payment or where covered by an active hosting, support, or maintenance agreement.
Hue Marketing is not responsible for delays, defects, or issues caused by client or third-party changes once access has been granted.
Website Intellectual Property
All intellectual property remains the property of Hue Marketing until all invoices are paid in full.
Upon receipt of final payment, ownership of the website structure, design, and client-supplied or approved content transfers to the client. Any licensed stock imagery remains subject to the original licence terms of the supplier.
Hue Marketing retains the right to display completed projects in portfolios, case studies, and marketing materials unless otherwise agreed in writing.
Website Content
Final, client-approved website content must be supplied before development commences. Content includes logos, copy, images, videos, and required metadata.
Unless specifically stated in the quotation, projects do not include copywriting, SEO research or optimisation, accessibility compliance, legal compliance, or video production. Additional services may be quoted separately.
Website Content Copyright & Indemnity
Clients must ensure they have appropriate rights and licences for all supplied content. The client agrees to indemnify and hold harmless Hue Marketing from any claims, damages, or legal costs arising from supplied or approved content.
Website Content Definitions
- Website Page: up to 600 words and 5 images
- Blog / Projects Page: template design plus 2–3 standard entries
- Gallery Page: 10–15 images
Content exceeding these definitions may require additional quotation.
Website Revisions
Website packages include one round of changes and one final round of minor text amendments. Each round must be submitted as a single, consolidated list. Additional revisions, structural changes, or meetings may incur additional costs.
Supplying of Website Copy
Final copy must be supplied clearly separated per page in digital format. Draft, handwritten, or incorrect copy resulting in rework may incur additional costs.
Supplying of Branding
Final branding files must be supplied in AI, EPS, or PDF format. Incorrect or non-final files may result in additional costs.
Supplying of Images/Photography
Images must be supplied in high-resolution formats. Stock imagery and photography may be sourced by Hue Marketing at additional cost if required.
Supplying of Videos
Videos must be hosted on third-party platforms such as YouTube or Vimeo. Hue Marketing does not host video files.
Browser & Device Testing
Websites are tested on current versions of major desktop browsers and popular mobile platforms. Testing on legacy or unsupported platforms is not included unless agreed in writing.
Search Engine & Performance Disclaimer
Hue Marketing does not guarantee traffic, rankings, conversions, or performance unless explicitly agreed in writing.
Damage, Loss & Security
Hue Marketing is not liable for damage, data loss, hacking, or security issues once the website has been handed over.
Website handover is deemed to occur upon launch, provision of credentials, or issuance of the final invoice (whichever occurs first). Ongoing responsibility applies only where a separate agreement is in place.
Where Website Care, Website Management, or related support services are provided, these are governed by the applicable service descriptions, inclusions, and limitations published on the Hue Marketing website at the time of agreement.
By proceeding with such services, the client confirms acceptance of those service terms in addition to these Terms & Conditions. In the event of any conflict, these Terms & Conditions take precedence.
WordPress, WooCommerce & Third-Party Services
All websites are built using WordPress and may use WooCommerce, themes, plugins, or third-party services. Hue Marketing does not control these platforms and is not responsible for disruptions, changes, or service discontinuation.
Website Development Payment Terms
- Initial 50% Payment. Payable upon quotation approval.
- 25% Progress Payment. Issued once the website is presented for client review. Payment is required before further work continues.
- Final Payment. Issued upon approval for launch and payable prior to launch
Where client-side delays occur, the final invoice may be issued 60 days after the initial invoice and remains payable regardless of launch status. Late payment may result in suspension of work or access.
Website Project Alterations
Additional pages, features, or changes outside the agreed scope may incur additional costs and will be agreed prior to invoicing.
Suspension & Termination
Hue Marketing may suspend or terminate projects where payments are overdue, required content is not supplied, or the project is dormant for more than 30 days. Fees paid remain non-refundable.
Cancellation
- Cancellation within 30 days of payment and prior to the planning meeting: refund less 10% administration fee.
- No refund applies after the website planning meeting.
Force Majeure
Hue Marketing is not liable for delays or failure caused by events beyond reasonable control.
Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of Thailand. The courts of Thailand have exclusive jurisdiction.
Hue Marketing Accreditation
Hue Marketing websites may feature a small footer accreditation. Removal may be requested and may incur an additional fee.
Acceptance
By proceeding with a website project, the client confirms acceptance of Hue Marketing’s Website Design Terms & Conditions in full.
Website Care & Management Policies
Hue Marketing
Scope of Services
Hue Marketing provides ongoing website care and management services for websites designed and built by our agency. In some cases, Hue Marketing may agree to manage websites developed by third parties, however additional review or setup work may be required before services can begin.
These services are offered under two service types:
- Website Care – for websites hosted and managed on Hue Marketing’s hosting environment.
- Website Management – for websites hosted externally on infrastructure controlled by the client or their chosen hosting provider.
Both services focus on maintaining the technical stability, security and operational health of the website.
Hosting Environment
For clients using Website Care, hosting is provided and managed by Hue Marketing through professional hosting infrastructure selected by our agency.
Hue Marketing manages server configuration, performance monitoring and hosting-related technical support with the hosting provider where required.
Whilst every effort is made to maintain maximum uptime and reliability, Hue Marketing cannot guarantee uninterrupted availability and is not liable for downtime or service disruptions caused by hosting providers, infrastructure issues or external network factors.
Website Maintenance
Website care and management services include routine technical maintenance such as:
- WordPress core updates
- Theme and plugin updates
- Security monitoring
- Backup monitoring
- General technical oversight
These services are focused on maintaining the technical health and security of the website platform.
Whilst updates are performed carefully, software updates may occasionally introduce compatibility issues between themes, plugins or third-party services. Hue Marketing will work to resolve such issues where reasonably possible.
Website care plans do not include unlimited development, redesign work or structural changes to the website.
Content Updates
Website care and management services focus on technical maintenance rather than ongoing content editing.
Requests for content changes such as:
- text edits
- image updates
- adding new pages
- layout changes
- new features or functionality
may be quoted separately where required.
Hue Marketing may occasionally perform very small adjustments at its discretion; however this should not be assumed to be included within the service plan.
Website Access
For security and stability reasons, Hue Marketing retains primary Administrator access to websites under its care to ensure security, stability and proper maintenance.
Clients may be provided Editor-level access upon request, allowing them to edit or manage website content.
Hue Marketing is not responsible for any issues, errors, or website damage resulting from:
- client edits
- third-party edits
- software or plugins installed without approval.
Any work required to restore or repair the website following such changes will be charged separately.
Administrator access may be granted upon request for websites hosted outside of Hue Marketing’s infrastructure. Hue Marketing cannot accept responsibility for issues caused by administrative changes made by clients or third parties.
Plugin & Software Policy
To maintain security, performance and compatibility, only plugins and software approved by Hue Marketing may be installed on websites managed under our care services.
Unauthorized software installations may create security vulnerabilities or performance issues and may be removed if deemed necessary to maintain the stability of the website.
Hue Marketing reserves the right to decline support or ongoing management of websites that have been significantly modified by third parties or contain unsupported software, plugins or custom code that may compromise stability or security.
Backups
Websites hosted under the Website Care service are automatically backed up on a regular basis as part of standard server management practices.
Whilst backups are maintained as a safeguard, Hue Marketing cannot guarantee recovery of all data in every circumstance and is not liable for data loss resulting from software failures, external attacks, user actions or server failures.
Clients are responsible for maintaining their own copies of critical website content and data where required.
Third-Party Services
Many websites rely on third-party platforms and services such as:
- payment gateways
- booking systems
- email marketing platforms
- analytics tools
- social media integrations
Hue Marketing is not responsible for the availability, functionality or policy changes of any third-party services.
Support related to third-party systems may require additional consultation or configuration work which may be quoted separately.
Intellectual Property & Software Licensing
Certain premium themes, plugins and software licenses used on Hue Marketing websites are owned and maintained by Hue Marketing as part of our development toolkit.
These licenses remain the intellectual property of Hue Marketing and are not transferable to the client.
If a website is moved to external hosting outside of Hue Marketing’s care, clients may be required to purchase their own licenses for any premium software used on the website.
Domain Name Ownership
Whilst Hue Marketing may assist with domain registration or management, all domain names remain the legal property of the client or their registered business entity.
Should a client wish to transfer their domain name to another provider, Hue Marketing will assist with the release process when requested.
Payment Terms
Website Care and Website Management services are billed quarterly in advance unless otherwise agreed.
Invoices must be paid prior to the commencement of each billing period.
Suspension of Services
Website care and management services may be paused if invoices remain unpaid beyond the billing period. During this time, routine updates, monitoring and technical support will not be performed.
Re-activation of Services
Websites that have not been actively maintained under Hue Marketing’s care services may require a technical review before services can resume in order to safely update software and verify system compatibility.
Release or Transfer of Website
Clients may cancel website care or website management services with 30 days’ written notice. If the website is hosted by Hue Marketing, hosting services will be terminated following the cancellation period.
Upon cancellation:
- If the website is hosted by Hue Marketing, hosting services will be terminated.
- Premium software licenses owned by Hue Marketing will be removed.
- The client will be provided with a standard export of the website files and database where applicable.
Clients are responsible for arranging new hosting, migration, and any required software licensing once the website leaves Hue Marketing’s management.
Hue Marketing is not responsible for configuring the website on external hosting environments unless a separate migration service is agreed.
Security Incidents
Whilst security monitoring and updates are performed as part of website care services, no website can be guaranteed to be completely secure. Hue Marketing cannot be held liable for security breaches, malware infections or hacking incidents resulting from vulnerabilities in third-party software, weak passwords, or actions taken by users with website access.
Review of Services
Hue Marketing reserves the right to review and adjust service pricing or inclusions periodically.
Clients will be notified in advance of any changes before they take effect.
